PayActiv, Inc. Under Investigation for Data Breach of Records

Schubert Jonckheer & Kolbe LLP is investigating a data breach that led to unauthorized access to the sensitive information of individuals affiliated with PayActiv, Inc. (“PayActiv”), a California-based financial services company that provides earned wage access.

On August 19, 2025, PayActiv identified suspicious activity on its network. PayActiv learned that an unauthorized actor gained access to sensitive information on its systems between April 3, 2025, and August 20, 2025. PayActiv has not disclosed the total number of individuals affected, but according to the Montana Department of Justice’s data breach portal, 174 Montana residents were affected.

Although the breach began in April 2025, PayActiv did not begin notifying affected individuals until on or around September 29, 2025, which may have violated state and federal laws. The following information may have been compromised in the breach: names and Social Security numbers.
